Terms and Conditions


In the following conditions of this contract "The Photographer" shall mean Lucinda Photography, The "Client(s)" shall be those whose name appears on the contract. By booking Lucinda Photography for your session, you agree to be bound by the Terms and Conditions set out below. They cannot be varied in any way by The Client(s) unless such conditions are expressly agreed by The Photographer in writing.

Professional Photography and Copyright Law: The 1988 Copyright Act assigns the copyright of the photographs to The Photographer. It is therefore contrary to the Act, and illegal to copy photographs, or allow to be copied, by any means photographic or otherwise, by any person or machine other than by The Photographer. 

Deposit/Booking Fee: The deposit is non refundable. Only when the deposit has been confirmed by the photographer will the booking be confirmed.   Dates will not be held prior to receipt of the deposit. This may result in missing out on a session due to availability.

Sessions: If a Watch Me Grow package is booked the client is therefore held responsible to inform/update the photographer of the milestones required for the session e.g. newborn, sitting unaided and birthday date. The client cannot cancel any particular session within the package. The full price will still be upheld even if the client misses/cancels a session within the package.

All sessions have a minimum order spend on products (excluding the session fee) at the viewing session. A session fee covers the time spent photographing your baby on the day of the session, an 5x7 Mounted Print and a carefully selected gallery of images - minimum of 20 fully edited images (minimum of 10 images for Maternity sessions). A maternity session requires no minimum spend. A Newborn, Sitting and Cake Smash session each holds a £225 minimum order spend.The 5x7 print must be of one that has is from your chosen selection.


The pricing structure may be altered. No notice for these changes are required. Prices will be held for 5 days after the viewing session only. After 5 days, any orders made will be subject to current pricing structure. 

The use of camera phones or other personal cameras is not permitted during the session.

Lucinda Photography and any employees or representatives will not be held liable for any harm/injuries or damage incurred by you or your families during your attendance at the studios. If you or your children use the facilities including the garden no responsibility will be held by the photographer/employees for any harm/injuries or damage and children must be accompanied/watched by a parent at all times.

Gift vouchers: These can be purchased for any value of more than £25. Vouchers can be used towards a session fee or towards the minimum spend/towards purchasing products. Vouchers will be coded for each individual. Vouchers can not be exchanged or refunded. Any Vouchers brought are affected by any price changes until the recipient has made contact and booked a firm session date.  Vouchers are valid for a limit of 6 months from the date purchased.

Display: Lucinda Photography respectfully requests that their images are not copied either for the purposes of downloading or reprinting or uploading to social networking sites. As well as infringing the above Act, the resulting copies will not reflect the quality of the original, which have been professionally edited: this could damage The Photographer's reputation for producing the highest standard of work. Images shall not be altered or manipulated. 


Products: All products (Frames, Acrylics, Canvases, Prints and Digital Images) are created to order and therefore are non-returnable and non-refundable at any time. All products will be ready for collection by the client within 4 weeks of the order date. The Photographer shall not be responsible for any delays due to supplier interruptions or postal service.


After 3 months from your viewing date Lucinda Photographer will no longer be responsible for storing The Clients Images.


Digital file packages include a print release certificate giving permission for the client to make unlimited copies. Copyright is retained by Lucinda Photographer.


In the rare event of your order being faulty or damaged, before it is released to the client upon collection, replacement of the faulty or damaged goods are guaranteed. Any damage to products must be reported within 24 hours of client collection. After this timescale, items will not be replaced. We strongly recommend that the clients back-up the digital images on multiple storage devices as soon as the USB is collected/ received. The USB of images will not be replaced due to client’s failure to do this.

Prints and canvases will be matched as closely as possible to the original image. Please note that your monitor may display the colours differently to the original, and that images seen in print may differ from the original due to processing methods.

While we take reasonable care in the performance of this Agreement, we shall not be liable for any loss or damage suffered by you or by any third party arising from use or reproduction of any image.

Photographer’s portfolio: To promote the work of Lucinda Photography and create new publicity material, the photographer needs to maintain a portfolio of recent work to show both existing and prospective clients. A selection of your images may be chosen to appear on the Lucinda Photography website and in promotional literature or any other relevant advertisement. The photographs will only be used in the context of promoting the work of Lucinda Photography. Client details are never shared with third parties and client confidentiality is respected at all times. 

Ordering: If the photo session or ordering appointment is cancelled within 48 hours by the client a small fee of £30 will be incurred.  All orders will be placed at the ordering/viewing session and paid for in-full on the day unless a payment plan is requested. No orders can therefore be cancelled or refunded once placed.  If a payment plan is in place a selected date will be chosen by the client for the payments to be made over a following two or three month period. The £225 minimum order spend must be included as the first instalment and paid on the day of the viewing. 

If the client is unhappy with their gallery of images for any reason the minimum order £225  will be upheld at the discretion of the Photographer.

COVID -19
Due to the current global outbreak of Covid-19 (also know as the Corona Virus, Coronavirus Novel CoronaVirus, SARS-CoV-2), The Photographer withholds the right to cancel or reschedule sessions without notice, limitation or justification. This is in line with the current WHO, CDC and Government recommendations in handling and containing the virus.

The Client is expected to comply with current hygiene and safety advice recommended by health services and also must agree to and abide by any additional hygiene terms the photographer may send the client prior to the session.

In the event The Photographer becomes unwell and is prevented from carrying out the booked session The Photographer will make every effort to reschedule the session on an alternative date once quarantine time has ended.

In the event The Client becomes unwell and cannot attend the photography session, The Client will receive a new date for a shoot once the quarantine time is over. If a new date is refused by The Client, the deposit already paid is transferable to a different shoot. Deposits are non-refundable.

If anyone attending the session (including but not limited to: The Client, The Client’s child or anyone else) appears to have symptoms of the virus (including but not limited to: a cough, fever or respiratory symptoms, mild or otherwise) they will be asked to leave immediately, and the session will be halted without notice or restriction. If anyone in the Client’s household becomes unwell with respiratory symptoms (as listed above), The Client has a duty to make the Photographer aware of this prior to the session. Failure to do so could result in termination of the contract and the spread of the disease.
